Terms of Service

The app

TimeCal is a one-time purchase. A license covers up to 2 Macs that you own or control, for personal or business use, and all future updates are included.

You may not resell, sublicense, or redistribute the app or your license key, and you may not work around the licensing system.

Private beta

TimeCal is currently in private beta. Beta builds are provided as they are and may change, break, or be withdrawn without notice. Do not treat a beta build as your only record of anything.

The waitlist

Joining the waitlist means we may email you about TimeCal’s launch, and nothing else. You can ask to be removed at any time at evan@trytimecal.com. The Privacy covers what we store and for how long.

Refunds

Once TimeCal is on sale, you may request a full refund within 14 days of purchase, for any reason or for none. Write to evan@trytimecal.com.

Your data

Your calendar data is yours. TimeCal reads it through Apple’s calendar system and keeps it on your Mac. Editing or deleting an event in TimeCal edits or deletes it in your calendar account, the same as any calendar app, so keep your own backups.

Third-party software

TimeCal includes Sparkle, the open-source update framework, used under the MIT license and copyright its authors. Sparkle’s full license text ships inside the app and is readable from About › Acknowledgments. Sparkle is not affiliated with TimeCal and provides no warranty for it.

Termination

This license ends if you break these terms, for example by redistributing the app or working around its licensing. You may stop using TimeCal and delete it whenever you like, for any reason or none.

No warranty

TimeCal is provided as it is, without warranties of any kind. We do not promise that it will be uninterrupted, error-free, or fit for a particular purpose.

Limits of liability

To the extent the law allows, our total liability for any claim relating to TimeCal is limited to what you paid for it, and we are not liable for indirect or consequential losses, including lost data or lost profits. Some places do not allow these limits, in which case they do not apply to you.

Communications

Transactional email is part of the service: your license key, receipts, and anything needed to deliver or support what you bought. You cannot opt out of these while you hold a license.

Product updates, release announcements, and anything else promotional are opt-in only. You choose to receive them, every one of them has an unsubscribe link, and unsubscribing never affects your license or your ability to use TimeCal.

Governing law

These terms are governed by the laws of the State of Washington, USA, without regard to its conflict-of-laws rules. Subject to the dispute resolution section below, you agree to the exclusive jurisdiction and venue of the state and federal courts located in King County, Washington.

Dispute resolution

Most concerns are settled by writing to evan@trytimecal.com, and we ask that you start there. If a dispute cannot be resolved informally, you and Sandpiper Media Group agree to resolve it through final and binding individual arbitration rather than in court, except that either party may bring an individual claim in small-claims court.

To the extent the law allows, disputes are resolved on an individual basis only: you and Sandpiper Media Group waive the right to a jury trial and the right to take part in a class action or class-wide arbitration. This section does not apply where it is prohibited by applicable law.

Assignment

You may not assign or transfer these terms or your license without our consent. We may assign these terms in connection with a merger, acquisition, reorganization, or sale of assets.

Changes

We may update these terms. If a change is significant, the date above changes with it. Continuing to use TimeCal after that means you accept the update.
